From a technical and economic perspective this is an innovative way to put into practice investments in the field of energy conservation both for small and medium size firms, consortia and whole industrial areas, as well as for the public administration.
With the reform of 2008 it has become possible to involve a private company in a beneficial project, thereby offering a means of overcoming the structural deficit through the employment of available resources from capital markets.
The procedure involved three phases: design, construction, management. (Smart City)
Preliminary Phase
The contract will have the following objectives:
a) The management of public lighting in communal areas;
b) The supply of electrical energy required for the aforementioned plant;
c) Ordinary and extraordinary plant;
d) bringing the plant into line with the norms (technical reconversion, updating and energy saving) through third party financing;
e) Through third party financing:
• designing the project
• obtaining authorisation and planning permission
• final inspection
thereafter, running the plant and bringing the entire system (cabinets, wiring, earth, protection from exposed wiring and so on) into line with safety and anti-pollution norms, subject to regular controls as required by law;
f) communicating the results of the project to raise public awareness of the benefits through third party financing.
Tenders
With reference to the new code on submitting tenders (comma 1 art. 183, d.lgs. n. 50/2016) for public works or works of public utility, inserted in the guidelines formally approved by the adjudicating commission on the basis of the current norm: “ as an alternative to the procedure for awarding concessions outlined in Part III, the adjudicators can award a concession placing at the basis of the competition the feasibility project, through publication of an announcement requesting offers that consider the use of resources totally or in part supplied by the competitors.”
Project Financing represents a particular method of awarding a concession, unlike the one, generally applied, in art. 164ss of the new code.
The former code (art. 153 d.lgs. 163/2006) made it obligatory that in the procedure regulating the financial aspects the public administration body had to provide a feasibility study. This study represented a necessary prerequisite for the inclusion of a work in the three year plan; this was a prerequisite for admission to the tendering process. Once issued notification of a public tender with attached feasibility study, the offers of the competitors had to contain the preliminary project of the work: as a consequence, all phases of the work were assigned to the private operator (preliminary, definitive, executive).
The new code regulating public procurement has radically reformed the norms governing design projects: first of all, this reform (art. 23 d.lgs. 50/2016) abolishes the feasibility study as a prerequisite of inclusion in the planning tools. Moreover, the levels of planning have been modified, taking into consideration that the preliminary plan is substituted by the technical and economic feasibility plan. On the other hand, it is actually the feasibility plan that constitutes today the minimum requirement for inclusion into the works within the planning tools.
The point of departure of the procedure, therefore, is the feasibility study that the contracting authority sets at the basis of the tender, given that it is now only the definitive and executive planning that is delegated to the adjudicators.
